THE POLICY OF LARGE SCALE SOCIAL DISTANCING IN THE SPECIAL CAPITAL REGION OF JAKARTA PROVINCE AS A RESPONSE TO THE COVID-19 PANDEMIC

The Governor of the Special Capital Region of Jakarta Province (“DKI Jakarta”) issued the Decree No. 380 of 2020 concerning the Enactment of Large Scale Social Distancing Implementation In Handling the Corona Virus Disease 2019 (COVID-19) in the Special Capital Region of Jakarta Province (“Governor Decree No. 380/2020”) to reduce the spread of Coronavirus Disease 2019 (“COVID-19”) in the territory of DKI Jakarta. As the implementing regulation of the Governor Decree No. 380/2020, the governor of DKI Jakarta also issued the Governor of DKI Jakarta Regulation No. 33 of 2020 concerning the Implementation of Large Scale Social Distancing in Handling the COVID-19 in DKI Jakarta (“Governor Regulation No. 33/2020”).

Furthermore, based on the Governor Decree No. 380/2020, the Large Scale Social Distancing (Pembatasan Sosial Berskala Besar/”PSBB”) policy has been into force since 10 April 2020 and will be applied until 23 April 2020. Furthermore, the PSBB policy may be extended for 14 (fourteen) days subject to the recommendation of the COVID-19 Handling Committee of DKI Jakarta (Gugus Tugas Percepatan Penanganan COVID-19 DKI Jakarta).

The Governor Regulation No. 380/2020 stipulates the guidance of the implementation of PSBB in DKI Jakarta. Furthermore, the notable provisions regulated under the Governor Regulation No. 380/2020 are among others:

  1. Restriction of activities
    As the implementation of the PSBB policy, the government of DKI Jakarta restricts several activities as follows:

    1. School and other academic institutions activities:
      Teaching and learning conducted by school and other academic institution (i.e. university, training institution, research institution, development institution and any other academic institution) must be conducted at home through the system that provided by its institution.

    2. Operation of offices and business activities:
      The government of DKI Jakarta temporarily suspends any work activities in the offices as well as business activities and applies a work from home system. However, there are several sectors that may still conduct its activities normally, as follows:

      1. Offices with the following category:
        1. central and regional government institution;
        2. foreign country representation offices and/or international organization conducting diplomatic and counselor function as well as other function pursuant to the international law provision; and
        3. state or regional owned enterprises involved in handling the COVID-19 pandemic and/or providing public primary needs.
      2. Business in the sector of:
        1. health;
        2. food and beverages;
        3. energy;
        4. communication and information technology;
        5. financial;
        6. logistic;
        7. hospitality;
        8. construction;
        9. basic services, public utilities and industry which deemed as the national vital objects and certain objects;
        10. daily needs; and
        11. strategic industries located in the territory of DKI Jakarta.
      3. Local and international public organization having activities related to disaster and/or social.

    3. Operation of offices and business activities:
      All religious places are closed and any religious activities shall be conducted at home.

    4. Activities in public facilities:
      The government of DKI Jakarta stipulates that it is prohibited to conduct activities that consist of more than 5 (five) people in an open area or public area. Furthermore, all of the public facilities both owned by the DKI Jakarta and owned by a private party will be fully closed except it is related to the activity of: (i) fulfilling the daily and primary needs of public (with the provision that take away and delivery system is a priority); and (ii) public doing sports privately.

    5. Social and culture activities:
      During the implementation of PSBB policy, activities related to social and culture that triggers voluminous crowd will be restricted. The said social and culture activities are related to (i) politic; (ii) sport; (iii) entertainment; (iv) academic; and (v) culture.However, as for wedding activity, it may be conducted with the provision that it is prohibited to organize a wedding reception. The marriage can only be done in private in the relevant institution (Religious Affairs or Civil Registry Office).

    6. Transportation operation and movement of people and goods using transportation:
      All of the operation of public transportation will be restricted and may only operate in certain time as further stipulated by the government of DKI Jakarta and the relevant authorized institution. Furthermore, public transportation may only provide 50% (fifty percent) of its capacity in transporting public for the intention of social distancing.

      In relation to private transportation, the government of DKI Jakarta still allows private transportation to operate in the territory of DKI Jakarta with the provision that it is only allowed for the purpose of fulfilling primary and daily needs as well as urgent matters and also limiting the passengers per vehicle.

  2. Social assistance and incentives by the government
    The government of DKI Jakarta will grant social assistance for publics having difficulties in fulfilling their daily needs through direct distribution of such daily needs.
    Incentives will also be granted to public businesses which impacted by the COVID-19 pandemic in the form of:
    1. reduction of tax and regional retribution;
    2. granting of social assistance for employees that are impacted by the implementation of PSBB policy;
    3. other assistance pursuant to the prevailing laws and regulation.

  3. Supervision by the government and sanction

The government of DKI Jakarta through the police officer and the national army of Indonesia will conduct patrols around the territory of DKI Jakarta to supervise the PSBB policy. The government will impose a sanction for any party that violates the PSBB policy.
