INDONESIA PROHIBITS ALL ARRIVAL AND TRANSIT BY FOREIGNERS IN INDONESIA

On 31 March 2020, Ministry of Law and Human Rights has issued a new regulation No. 11 of 2020 Regarding the Temporary Ban for Foreigners to Enter into Indonesia (“Permenkuham No. 11/2020”). Through this Permenkuham No. 11/2020, Indonesian Government prohibits all foreigners to enter or transit in Indonesia.

Does the Permenkuham No. 11/2020 give any exception to the foreigners? The answer is yes. For the following foreigners are still allowed to enter into Indonesia:

  1. The holder of Limited Stay Permit (Izin Tinggal Terbatas/ITAS) or Permanent Stay Permit (Izin Tinggal Tetap/ITAP);
  2. The holder of Diplomatic Visa or Service Visa (Visa Dinas);
  3. The holder of Diplomatic Stay Permit and Service Stay Permit;
  4. Medical Aids, foods, and humanitarian assistance staff;
  5. Transportation staff; and
  6. The foreigners who are working in National Strategic Project (Proyek Strategis Nasional).

However, the above foreigners must complete the following requirements upon arrival at Indonesian Airport:

  1. Health certificate in English language issued by the relevant health authorities from their respective countries (in practice, the maximum date of health certificate should be dated 7 days prior arrival at Indonesian Airport);
  2. Evidence have been staying for more than 14 (fourteen) days in areas or countries which are free from corona virus; and
  3. The signed statement letter which is stated willing to be quarantined for 14 (fourteen) days by Indonesian government.

Further, the Article 4 and 5 of the Permenkuham No. 11/2020 stipulate that foreigners who cannot renew their visa or stay permit in Indonesia will be granted the Emergency Stay Permit (Izin Tinggal Keadaan Terpaksa) automatically. This Emergency Stay Permit is granted for free.

The Permenkuham No. 11/2020 has revoked the following regulations:

  • Ministry of Law and Human Right Regulation Number 8 of year 2020 concerning the Free Visit Visa and Visa on Arrival and the Granting of Emergency Stay Permit dated 18 March 2020; and
  • Ministry of Law and Human Right Regulation Number 7 of year 2020 concerning the Granting Visa and Limited Stay Permit For Preventing the Spread of COVID-19 dated 28 February 2020.

The Permenkuham No. 11/2020 is come into force on 2 April 2020.
